Indisputably, the impugned order passed by the D.C.L.R. is appealable under the provisions of The Bihar Land Disputes Resolution Act, 2009.

In above view of the matter, after some argument, the learned counsel appearing on behalf of the petitioners, in presence of the learned counsel appearing on behalf of the respondents, seeks permission to withdraw the present writ petition with a liberty to file an appeal before the prescribed appellate authority. Permission is accorded.

The writ petition stands disposed of as withdrawn

Patna High Court CWJC No.11885 of 2014 (3) dt.27-10-2016 with the liberty aforesaid.

It goes without saying that, if an appropriate appeal is filed on behalf of the petitioners within a period of one month from today, after impleading all the necessary parties including the respondents herein, then the petitioners shall be at liberty to raise all the issues of facts and law, which may be available to them, with respect to the lands in question as also the order impugned.
