2. The petitioners by invoking the jurisdiction of this Court seeking a direction upon the respondents to ensure
Patna High Court CWJC No.12610 of 2024(2) dt.03-09-2024 2/3 payment of compensation amount alongwith statutory interest, for the land of the petitioners, which was acquired under the Land Acquisition Case No. 10-43(2)/15-16, for construction of Indo-Nepal Border Road on the basis of the report submitted by a committee consisting of six members by the order of the District Collector, Supaul, whereby, the land of the petitioners were reported to be homestead lands.
3. The grievance of the petitioner is in narrow compass and submission has been made at the Bar that identically situated persons approached before this Court, whose claim was duly considered and he has been awarded appropriate compensation by treating his land as homestead land.
4. The case of the petitioners are identical to that of Arbind Kumar Singh, who has approached before this Court in CWJC No. 8695 of 2016, is the contention of learned Advocate.
5. Considering the nature of the grievance and taking note of the fact that the petitioners have filed objections before the Land Acquisition Officer, Supaul and the same is pending consideration, the writ petition stands disposed of with a direction to the respondent no. 5 to consider the objections of the petitioner and disposed of the same preferably within a period of three months from the date of receipt of this order.
Patna High Court CWJC No.12610 of 2024(2) dt.03-09-2024 3/3 Suffice it to say that if the claim of the petitioners find identical to that of Arbind Kumar Singh, similar relief is to be accorded to the petitioners.
