NILU AGRAWAL ORAL ORDER 07-09-2017 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. Petitioner seeks bail in connection with Sirdala (Meskaur) P.S. Case No. 69/17 for offences punishable under Sections 366-A/34 of the Indian Penal Code.
The prosecution case, as lodged by the informant, who is the mother of the victim girl Kajal Kumari, is that on 01.03.2017 the petitioner along with others have abducted her minor daughter aged 15 years on gun point.
It has been submitted by the learned counsel for the petitioner that he has now married the victim girl and she is in her advanced stage of pregnancy.
Patna High Court Cr.Misc. No.28437 of 2017 (4) dt.07-09-2017 2/3 On 02.08.2017, the petitioner was released on provisional bail and directed to appear before this Court on 07.09.2017 i.e. today. The Incharge, Nari Niketan, Gaighat, Patna was also directed to bring the victim girl Kajal Kumari before this Court.
In pursuance to the said order, the Incharge, Nari Niketan, Gaighat, Patna has appeared along with the victim girl Kajal Kumari. The petitioner is also present. Both petitioner and Kajal Kumari are willing to live with each other as husband and wife. The victim Kajal Kumari is in her advanced stage of pregnancy and it has been informed by the Incharge, Nari Niketan, Gaighat, Patna that her delivery date is sometime in November. Under such circumstances, the provisional bail granted to the petitioner under order dated 02.08.2017 is hereby confirmed and petitioner is directed to appear before the court of learned ACJM-V, Nawada on 14.09.2017. The victim girl Kajal Kumari will also be produced before the court below on the same day along with a lady constable, on which date the petitioner will take Kajal Kumari, his wife to her matrimonial home. Registry is directed to send a copy of this order to the Incharge, Nari Niketan, Gaighat, Patna and also to the Senior Superintendent of Police, Patna through fax for the needful action.
