JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This is an application for grant of anticipatory bail in connection with Excise Case No. 88 of 2019, disclosing offences under Sections 30(a), 30(d), 30(f) of the Bihar Prohibition and Excise Act, 2016.

As per F.I.R. there is recovery of 200 liters of liquor and petitioner is also named in the F.I.R.

Submission of the learned counsel for the petitioner is that the materials collected during the investigation clearly shows that recovery is from the shop of one co-accused Golu Singh and petitioner has falsely been implicated in this case, having no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner,

Patna High Court CR. MISC. No.60565 of 2019(3) dt.15-10-2019 2/2 above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur, in connection with Excise Case No. 88 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
