The petitioner is in custody in connection with Baisi P.S. Case No. 45 of 2019 for the offences under Sections 147, 341, 323, 307, 379, 504, 506 and 427 and later on added Section 302 of the Indian Penal Code.

Learned senior counsel for the petitioner would submits that the petitioner has got no criminal antecedent. Learned senior counsel for the petitioner would submits that there is specific allegation of assault against the coaccused and not against the present petitioner. He further submits that one of the co-accused have already been granted anticipatory bail by the co-ordinate Bench of this Court. The petitioner is in custody since 02.06.2019.

No.54620 of 2019(2) dt.05-09-2019 2/2 Considering the fact that there is no specific allegation against the petitioner, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Chief Judicial Magistrate, Purnea in connection with Baisi P. S. Case No. 45 of 2019.

However, it is made clear that the bailer should be family member of the petitioner.
