JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-03-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with Bahadurpur P.S. Case No. 69 of 2015, registered under Sections 147, 148, 149, 341, 323, 325, 307 and 302 of Indian Penal Code, and Section 27 of the Arms Act, pending in the Court of Chief Judicial Magistrate, Darbhanga.

The accusation against the five named accused persons, including the petitioner, is that on 12.03.2015, they along with 5-6 unknown miscreants came to the house of informant and dragged Surendra Sahni, husband of the informant and caused assault to him, subsequently, he died at D.M.C.H. Darbhanga.

Learned counsel appearing on behalf of the petitioner submits that petitioner has been falsely implicated in this case due to grudge and enmity.

No.1480 of 2016 (3) dt.04-03-2016 2/2 On the other hand, learned counsel for the State vehemently opposed the prayer of the petitioner and submits that petitioner and others dragged to Surendra Sahani and caused assault. In Postmortem report of deceased Surendra Sahani more than five injuries were found caused by hard and blunt substance, which was the cause of death.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner, above named, is rejected (Rajendra Kumar Mishra, J) manish/- U T
