JUSTICE SUDHIR SINGH ORAL ORDER 08-11-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The following reliefs have been sought for on behalf of the petitioner in the present writ application. "1. That the petitioner prays for cancelling by an appropriate writ or an order the appointment of respondent no. 9, Bamkumar Paswan, as a Teacher of New Primary School, Madhanpur under Simri Bakhtiarpur Prakhand, District-Saharsa, the letter of appointment may be called for from the Gram Panchayat and the appointment

Patna High Court CWJC No.16054 of 2012 (3) dt.08-11-2017 2/2 of petitioner may be reinstated/restored to its original position also by calling for the same as the petitioner has never got his letter of cancellation of appointment but the decision was taken in the General Body Meeting of the Panchayat dated 12.06.2008."

The petitioner has further stated in paragraph no. 12 of the writ application that he had approached the District Appellate Authority, Saharsa, for redressal of his grievance but since he had no knowledge regarding the date fixed for hearing by the District Appellate Authority. Saharsa. The said appeal was dismissed for non-prosecution.

The petitioner is directed to file afresh appeal before the District Appellate Authority, Saharsa, within a period of thirty days from the date of order which shall be disposed of within the statutory period.

With the aforesaid observations and directions, the present writ application stands disposed of.
