Petitioners are apprehending their arrest in connection with Baisi P.S.Case no.45 of 2019 , registered for offences punishable under Sections 147, 341, 323, 307,379, 504, 506, 427 of the Indian Penal Code.

Prosecution story is that the petitioner and other accused persons came variously armed and started plucking Tori from his field and when he protested , on the order of the petitioner no1., other accused persons assaulted his brother by Dabia and further allegation against the petitioner no.1 is of snatching of Rs.15,000/- and they were in drunken condition. Submission of the learned counsel for the petitioners is

No.51284 of 2019(2) dt.17-08-2019 2/2 that there is case and counter case between the parties and though the FIR does not disclose any allegation attributed against the father of the informant but as father of the informant later on died, as such Seciton 302 of the IPC has also been inserted.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, surrender before the learned court below and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Purnea in connection with Baisi P.S.Case No.45 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
