JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 28-09-2015 Heard learned counsel for the petitioner and the State. The writ application has been filed for the following relief as culled out in para-1:- "1. That this writ application is for issuance of a writ, order or direction commanding and directing the Respondents authorities to operate and execute works of B.M.C. Maktab Lerua, Saran, Chapra, through Gram Panchayat Raj Tejpurwa and not through Gram Panchayat Raj Awari, which is most illegally being done through Gram Panchayat Awari."

Considering the prayer made in the application and

Patna High Court CWJC No.17630 of 2011 (2) dt.28-09-2015 2/2 the scope of the jurisdiction, the counsel for the petitioner submits that the writ application be permitted to be withdrawn allowing the petitioner liberty to raise grievance in this regard before the appropriate authority/forum which may include the respondentDistrict Magistrate for ventilation of the said grievance. The State has no objection.

The writ application is permitted to be withdrawn with the said liberty.
