2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 103(1) and 3(5) of the BNS with added Section 61(2) of BNS and Section 27 of Arms Act.
3. The prosecution case, in brief, is that on 16.04.2025 at about 08:00 A.M. while the informant was present at his house, his son Majnu Gaddi went outside along with petitioner and others. In the evening, informant came to know that all the FIR named accused persons including this petitioner committed murder of the son of the informant and dead body of his son was found lying on the road.
4. Learned counsel for the petitioner submits that informant is not an eye witness to the alleged occurrence. Only
Patna High Court CR. MISC. No.53479 of 2025(3) dt.20-11-2025 2/2 suspicion has been raised against this petitioner because the son of the informant went along with this petitioner. During course of investigation, name of the petitioner transpired in the confessional statement of co-accused Takku Gaddi @ Taku Gaddi. Petitioner is in custody since 18.04.2025.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, Rohtas in connection with Sasaram (M) P. S. Case No. 127 of 2025.
