Petitioner is said to have given several dagger blows to the informant but annexure 2 to this petition shows that informant was brought to Sadar hospital, Purnea on the alleged date of occurrence and he was discharged from the said hospital on the same day for getting better treatment.

The discharge slip of the informant shows that injury on abdomen of the informant was found and subsequently, he is said to have taken to private hospital where he got treated. It is surprising enough that Medical officer of Purnea Sadar Hospital did not issue any injury report of the informant. Moreover, petitioner is in jail custody since 20.10.2015 and, therefore, taking into consideration the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner
