JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-08-2019 This application, for grant of anticipatory bail, arises out of Mirganj P.S. Case No. 65 of 2019, disclosing offences under Sections 363, 366A/34 of the Indian Penal Code.

Allegation as per F.I.R. is that petitioner no. 2 and one co-accused kidnapped the minor daughter of the informant and petitioner is also named in the F.I.R.

Submission of learned counsel for the petitioners is that they have falsely been made accused in this case and there was love affair between the son of petitioner no. 1 and the daughter of the informant and due to which, they fled away. Learned counsel for the State opposed the prayer for

Patna High Court CR. MISC. No.51302 of 2019(2) dt.17-08-2019 2/2 bail and submitted that the girl is still traceless. Having heard both sides, considering the facts and circumstances and also the fact that the girl is still traceless, I am not inclined to grant the privilege of anticipatory bail to the petitioners rather petitioners.

This application is, accordingly, dismissed.
