Petitioner is named in the first information report but informant only expressed his suspicion against the petitioner and similarly, in course of investigation, it appears that informant and one witness vide paras 7 and 8 of the case diary expressed their suspicion against the petitioner.
However, after due investigation, police found petitioner innocent and submitted charge sheet against other accused persons. The victim has already been recovered and at the time of recovery, five other co-accused were caught along with victim for which Parbatta (Bharatkhand) P.S. Case no. 283/2015 was registered and in the said case, petitioner was not made accused. Petitioner does not have any criminal antecedent.
Accordingly, petitioner is directed to be released on bail on
Patna High Court Cr.Misc. No.784 of 2016 (2) dt.11-01-2016 furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Khagaria in Morkahi P.S. Case no. 74/2015. shahid (Hemant Kumar Srivastava,J) U T
