JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-01-2023 The present petition has been filed for modifying the order dated 12.06.2020, passed in Cr. Misc. no. 62833 of 2019 to the extent that the time granted to the petitioner to surrender before the learned court below and avail the privilege of anticipatory bail, be modified and two weeks' further time be granted from today for the said purpose.

The learned counsel for the petitioner has submitted that firstly, the petitioner had become seriously ill and was suffering from Acute Hepatitis, whereafter, his grandmother has died, leading to the petitioner not being able to surrender before the learned court below within the prescribed time. Having regard to the submissions made by the learned counsel for the petitioners as also considering the averments

Patna High Court CR. MISC. No.69877 of 2022(2) dt.11-01-2023 2/2 made in the present petition, I deem it fit and appropriate to grant two weeks' further time to the petitioner to surrender before the learned court below for the purposes of being admitted to the privilege of anticipatory bail, however, rest of the conditions mentioned in the order dated 12.06.2020 shall remain as it is.

It is needless to state that in case, the petitioner does not surrender within a period of two weeks from today, the privilege of anticipatory bail, granted vide order dated 12.06.2020 shall stand cancelled.

The present petition stands disposed off with the aforesaid modification in the order dated 12.06.2020, passed in Cr. Misc. no. 62833 of 2019.
