JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-03-2023 After some argument, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail petition so far as petitioner no. 1 & 2 namely Lal Babu Sah and Raja Babu Sah granting liberty to them to surrender and make prayer for regular bail.
Permission is accorded. The anticipatory bail petition stands dismissed as withdrawn with liberty, as indicated above. Remaining petitioners i.e. petitioner no. 3, 4 & 5 apprehend their arrest in a case registered for the offence under Section 307 354(B) & other allied sections of the Indian Penal Code.
Patna High Court CR. MISC. No.59688 of 2022(3) dt.16-03-2023 2/2 It is submitted on behalf of petitioners that there is case and counter case between the parties. It is further submitted that the injury caused by these petitioners (i.e. petitioner no. 3, 4 & 5) are simple in nature. Both parties are close door neighbours.
Considering the aforesaid facts and circumstances as well as nature of injury, the prayer for anticipatory bail of petitioners is allowed. Let the petitioners i.e. petitioner no. 3, 4 & 5, as named above, in the event of arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Ramgarhwa P.S. Case No. 310 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
