A scuffle took place between the parties on account of land dispute as well as flow of drainage and in that scuffle, one person, Dhurp Sharma died. There is specific allegation in the FIR that Dhurp Sharma was assaulted by Umesh Sharma, Shyam Sunder Sharma, Anoj Sharma and Sanoj Sharma. So far as the petitioners are concerned, it is stated that they along with several other accused assaulted injured Ramashish Sharma and Rambali Sharma. It is pointed out on behalf of the petitioners that both aforesaid injured sustained simple injury and moreover, having more or less similar allegation some co-accused have already been granted privilege of bail.

Considering the aforesaid facts and circumstances as well as

No.1881 of 2016 (2) dt.22-01-2016 submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Sri Jitesh Kumar, Judicial Magistrate, Ist Class, West Champaran, Bettiah / concerned court in Kangali P.S. Case no. 26/2015.
