Petitioner is in custody in connection with Rail P.S. Bakhtiyarpur Case No. 51 of 2019 for the offence under section 8/20(b)(ii) B of N.D.P.S. Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

In the instant case total 8 kg. Ganja has been recovered.

Petitioner is in custody since 31.3.2019.

Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on

Patna High Court CR. MISC. No.51908 of 2019(2) dt.22-08-2019 2/2 furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, Patna, in connection with Rail P.S. Bakhtiyarpur (Barh) Case No. 51 of 2019 subject to the condition that petitioner shall deposit Rs. 25,000/- (Twenty Five Thousand) cash in the court below which shall be abide by final outcome of the pending criminal case i.e. in the event of acquittal the amount shall be refunded to the petitioner otherwise the amount shall be forfeited.
