This is a petition for grant of regular bail for offence under Sections 302 and 328 of the Indian Penal Code. The informant and others, including the petitioner, had taken toddy at the shop of the petitioner. When they returned at their houses they found themselves uneasy and during treatment Basant Kumar died.
Submission of the learned counsel for the petitioner is that this is not a case of intention death caused by the petitioner nor there is material to substantiate that any extraneous material was adulterated with the said toddy.
Considering the entire facts and circumstances, aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Rafiganj P.S. Case No. 30 of 2017 to the satisfaction of the Chief Judicial Magistrate, Aurangabad, or successor Court.
