This is an application for bail in connection with Jalalpur P.S.Case No. 128 of 2015 registered for the offences punishable under Sections 304B/34 of the Indian Penal Code. Petitioner is the husband and the case is dowry death. It has been submitted on behalf of the petitioner that at the time of occurrence the petitioner was not present and nothing specific has been alleged against him.

Heard learned APP also, who has opposed the prayer for bail stating that dead body was found 100% burnt condition and allegation against the petitioner is torture and demand of dowry.

Having heard both sides and considering the aforesaid

Patna High Court Cr.Misc. No.30371 of 2017 (3) dt.27-07-2017 2/2 facts and circumstances, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.

However, learned trial court is directed to expedite the trial.

With the above observation, this application is dismissed.
