JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-01-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The contention on behalf of the petitioners is that the Circle Officer as well as other officials made attempt to illegally dispossess the petitioners and others from disputed land and in that course, they started demolishing the houses of the petitioners and others on account of which the alleged occurrence is said to have taken place.
It is further pointed out by him that the informant and other officials had got no authority to evict the petitioners and others from the disputed land in guise of order passed under Section 144 of the Code of Criminal Procedure.
Patna High Court Cr.Misc. No.2659 of 2016 (2) dt.29-01-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bagaha, District- West Champaran in connection with Dhanha P.S. Case No.114 of 2015.
