Petitioner is languishing in judicial custody since 06.02.2017 in connection with Turkaulia (Raghunathpur OP) P.S. Case No. 61 of 2017 for offences punishable under Sections 419, 420 of the Indian Penal Code and Section 3⁄4 of the Bihar Conduct of Examination Act, 1981.

The prosecution case, as lodged by the Center in-charge of the M.S. Memorial Public School, Belganga, Raghunathpur O.P. Motihari is that the petitioner was caught red handed while he was cheating and having chit of answers during examination of his intermediate level joint competitive examination, 2014 held on

Patna High Court Cr.Misc. No.29885 of 2017 (4) dt.08-08-2017 2/2 05.02.2017. The petitioner was expelled from the examination hall.

It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal antecedent and that charge-sheet has already been submitted and there is no chance of tampering with the prosecution witness by the petitioner. He submits that he has been suitably punished and he is a student, hence a sympathetic consideration be given.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Turkauliya (Raghunathpur OP) P.S. Case No. 61 of 2017, subject to the condition that petitioner will appear before the learned court below during trial as and when required and failure to appear on two consecutive dates without assigning any reason will entail cancellation of his bail bonds (Nilu Agrawal, J) U T sushma/-
