JUSTICE MADHURESH PRASAD ORAL ORDER 01-10-2019 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 341, 323, 504, 506, 307, 379/34 of the IPC.

Counsel for the petitioner submits that occurrence took place at the spur of moment on account of dispute between two sisters in relation to the property. Same led to lodging of case and counter case. Bhagalpur Kotwali (Jogsar) P.S. case no. 782/2018 was instituted by wife of the petitioner in relation to the same occurrence.

Normalcy has been restored between the parties and parties have filed petition in the court below stating that there is good relation and they are not pursuing the matter in court.

Patna High Court CR. MISC. No.51863 of 2019(3) dt.01-10-2019 2/2 Certified copy of FIR and compromise petition have been placed on record today.

Petitioner is in custody since 23.04.2019.

Considering the aforesaid submissions, prayer for bail is allowed.

Let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in Kotwali (Jogsar) P.S. Case no. 781/2018 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
