JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report and informant claimed that one witness, namely, Amrita Kumari disclosed before him that the deceased was taken away by the petitioner and after that when informant went near the place of occurrence he claimed to have seen the petitioner fleeing from the place of occurrence where the dead body of the deceased, who happened to be a seven years old girl, was recovered. The trial of the petitioner has already commenced and only doctor and investigating officer have been left to be examined.
Patna High Court Cr.Misc. No.2306 of 2016 (2) dt.27-01-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Sandesh P.S. Case No. 169 of 2014 corresponding to POCSO Case No. 22 of 2014 pending in the court of Additional Sessions Judge-I, Ara stands rejected.
However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible.
