JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-06-2018 The grievance of the petitioner in the present writ application is confined to payment of salary for the period 02.04.2008 to 09.03.2010. There is dispute whether the petitioner has worked during the aforesaid period. Learned counsel for the petitioner has placed reliance on the attendance sheet to contend that the petitioner has worked. The issue whether the petitioner has worked or not is to be decided by the University on the basis of record available to the University/College, the petitioner claimed to have performed his duty.
In view of the above, the petitioner is granted liberty to file exhaustive representation indicating therein the details as
Patna High Court CWJC No.1333 of 2012(5) dt.26-06-2018 2/2 to the period in which he has worked in the College in question and the University is required to verify the claim of the petitioner from the record available with the University/College and take final decision on the claim of the petitioner for payment of salary for the aforesaid period i.e. 02.04.2008 to 09.03.2010 and in case the University admits that the petitioner has worked during the aforesaid period, the University is required to make payment of remuneration for the aforesaid period within a maximum period of three months from the date of receipt/production of a copy of this order. With the aforesaid, the writ petition stands disposed of.
