The petitioner seeks bail in Imamganj Lutua P.S. Case No. 3 of 2017 registered for the offences punishable under Sections 25(1-B) a, 26, 35 of the Arms Act.

The police got information that Santosh Jee @ Santosh Bharti @ Sukan Bharti bodyguard of Indal Jee @ Uma Bhokta had came to village Asurain, on such a raid was conducted and the petitioner was apprehended. From the possession of the petitioner one loaded country made pistol was recovered. Learned counsel for the petitioner submits that the petitioner is innocent and false recovery of arms was shown from the possession of the petitioner. The petitioner has got no criminal antecedent as he has stated in paragraph-3 of the bail petition. Considering the facts aforesaid and the facts that only

No.19626 of 2017 (3) dt.20-06-2017 2/2 one looted country made pistol was recovered from the possession of the petitioner and for that the petitioner is in jail for last five months and he has got no criminal antecedent, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, Gaya in Imamganj Lutua P.S. Case No. 3 of 2017, subject to the condition that one of the bailors shall be close relative of the petitioner.
