JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-01-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner no. 1 happens to be Bhaisur whereas petitioner no. 2 is Gotni of the deceased. The present case has been lodged on the basis of fardbeyan of deceased, who stated that petitioner no. 2 had illicit relation with her husband and when she made protest, she was caught by the petitioners and other accused and after that petitioner no. 2 poured kerosene oil whereas her husband lit fire on her.

The above stated statement of the deceased appears to have dying declaration of the deceased, so even if the aforesaid statement of the deceased is assumed to be true, it was her husband who lit fire on her body.

No.1414 of 2016 (2) dt.14-01-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 3rd Additional Sessions Judge, Munger in connection with Session Trial No. 950 of 2014 arising out of Kashim Bazar P.S.Case No. 59 of 2014.
