The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 342, 379, 307, 427 of the Indian Penal Code and Section 27 of the Arms Act. It appears that vide order dated 12.07.2022 passed in Cr. Misc. No. 60540 of 2021, the petition with respect to the petitioner has been permitted to be withdrawn.

It is a case of assaulting an opening fire in the air.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.58388 of 2022(2) dt.16-11-2022 2/2 petitioner that petitioner has falsely been implicated in this case. The specific accusation of assault and opening fire is against co-accused Atish Kumar and Ajay Kumar. No specific allegation has been levelled against the petitioner. There is counter version of the occurrence also. There is no accusation of repeating the blow. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Danapur, Patna in connection with Bihta P.S. Case No. 398 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Shageer/- U T
