JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-03-2016 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners of both the applications are accused in connection with Khodawandpur P.S. Case No. 226 of 2013 registered under Sections 302 and 120(B)/34 of the I.P.C. Therefore, both applications are being heard together and disposed of by this common order.

Patna High Court Cr.Misc. No.1756 of 2016 (3) dt.01-03-2016 2/3 Learned counsel appearing on behalf of the petitioners submits that it would appear from the F.I.R. that on the basis of the fardbeyan of Draupadi Devi, Khodawandpur P.S. Case No. 226 of 2013 was instituted under sections 302 and 120(B)/34 of the I.P.C. against unknown and in the fardbeyan, the Registration Number of the Scorpio was also detailed, which was recovered just after the occurrence in abandoned condition. In course of investigation, it has come in paragraph no.

37 of the case diary that white colour Scorpio was belonging to one Rajesh Ranjan and the same was being used by Circle Officer, Chaurahi, but later on, the Police got managed to record the confessional statement of Mahesh Das to the effect that at the house of Manoj Yadav, planned was made regarding the present occurrence, in which petitioner Ranjeet Thakur, Manoj Yadav, Faiyaz Alam, Arun Kumar Singh and Pawan Kumar Chaurasia were also present and thereafter, Rajesh Mahto, husband of the informant, was dashed by the Bolero vehicle. Except the confessional statement of Mahesh Das, there is nothing against the petitioners. It is also submitted that petitioners have no criminal antecedent and is in custody since 18.06.2015.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail on

Patna High Court Cr.Misc. No.1756 of 2016 (3) dt.01-03-2016 3/3 furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Manjhaul, Begusarai in connection with Khodawandpur P.S. Case No. 226 of 2013.
