JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be mother-in-law of the deceased and the statement of deceased was recorded in hospital and in the said statement, she specifically, stated that it was the petitioner, who lit fire on her body.

Considering the aforesaid facts and circumstance as well as submission of the parties, particularly, keeping in mind that the statement of deceased amounts to her dying declaration, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Alamganj P.S. Case No. 330 of 2014 pending in the court of learned Additional Chief Judicial Magistrate, Patna City stands rejected.
