The petitioner seeks bail in connection with Warishnagar P.S. Case No. 281 of 2016, registered under Sections 328, 302 and 201/34 of the Indian Penal Code. The allegation of informant Mahesh Mahto is that marriage of his daughter Manju Devi was performed with the petitioner before 20 years and there were three children out of the wedlock. After death of Manju Devi, this petitioner performed his second marriage, but thereafter his grand daughter Manisha Kumar was being tortured by the petitioner and his second wife in respect to petty matters. Learned counsel for the petitioner submits that admittedly petitioner is the father of Manish Kumari, grand daughter of the informant, but she died due to illness in which informant and others had also come, but with ulterior motive the present case has been lodged. The petitioner is in custody since 04.04.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur in connection with Warishnagar P.S.
