2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in a case instituted for the offence punishable under Sections 341, 323, 307, 384, 379, 427/34 of the Indian Penal Code and Section 27 of Arms Act.

3. As per allegation in the F.I.R., petitinoner along with other co-accused persons, variously armed, came to the shop of informant and torn the aluminum sheet, caught hold the informant and started assaulting him. It is further alleged that co-accused Chandan and Sakesh assaulted the informant

Patna High Court CR. MISC. No.60617 of 2024(4) dt.05-03-2025 2/3 by means of butt of their pistol due to which he sustained injuries over his head. All the persons damaged grosary articles and took away Rs. 20,000/- from the cash box of his shop.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. There is no specific allegation against the petitioner rather the specific allegation of assaulting to informant is levelled against co-accused Chandan and Sakesh. Both the parties are co-villagers. Petitioner has no concern either with the alleged car by which the accused persons had come.

5. Learned A.P.P. for the State has vehemently opposed the prayer of bail.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Kudhani P.S. Case no. 84 of

Patna High Court CR. MISC. No.60617 of 2024(4) dt.05-03-2025 3/3 2024, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, West, Muzaffarpur, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
