JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and the marriage of petitioner had taken place with the deceased three years ago. The death of deceased took place at her natal place in other than normal circumstances. The postmortem report of the deceased shows that some injuries were found on her person. The informant and some witnesses claimed that one day prior to the alleged occurrence, the petitioner had come to the natal place of the deceased and in Panchayati, he had demanded one gold chain. Furthermore, the informant and other witnesses claimed that the deceased as well as the petitioner had left their

Patna High Court Cr.Misc. No.1247 of 2016 (4) dt.08-03-2016 home to live themselves but the deceased did not return and, thereafter, her dead body was found in a maize field. The reason behind the alleged occurrence is that the petitioner did not like the deceased.

Admittedly, none has seen actual killing of the deceased who died at her natal place.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Karai P.S. Case No. 54 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda.
