02. 13.07.2017 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in a case registered for offences under Section 30(a) of the Prohibition of Bihar Excise (Amendment) Act, 2016.

It is contended that, as per allegation, 80 litres of country-made liquor were recovered from the motorcycle which was being driven by the petitioner who tried to escape but the villagers caught him on chase and sent to police custody. The petitioner was referred to PMCH under police custody, thereafter, he was remanded to judicial custody on 15.04.2017.

Petitioner claims that he is having

Patna High Court Cr.Misc. No.31832 of 2017 (2) dt.13-07-2017 clean antecedent and is in custody since 15.04.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Nawada in connection with Akbarpur P.S. Case No. 219 of 2016 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
