JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-06-2018 Petitioners apprehend their arrest in connection with Kishanganj P.S.Case No. 590 of 2017 registered for the offences punishable under Sections 224, 225, 353, 332, 504, 506 and 120B/34 of the Indian Penal Code.

Allegation against the petitioners is that when police came for investigation of Kishanganj P.S.Case No. 508 of 2015 they have obstructed the police in investigation of that case and petitioner No.1 was fled. He was accused in that case. Submission of learned counsel for the petitioners is that petitioners Nos. 2 and 3 are ladies and there is no specific allegation against them and petitioner No.1 has also falsely been implicated.

No.32228 of 2018 (3) dt.28-06-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioners Nos. 2 and 3, named above, in the event of their arrest or surrender be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj, in connection with Kishanganj P.S.Case No. 590 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned. So far petitioner No.1 is concerned, he is directed to surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order. This application is disposed of with the above observation.
