The petitioner seeks bail in connection with Excise Case No. 261 of 2021 instituted for the offences under Sections 30(a) and 56(b) of the Excise Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 22.09.2021, is a person with clean antecedent and prosecution report has been submitted in the case.

Learned counsel for the petitioner submits that allegation is of recovery of 140 litres of liquor from an Alto Car and the petitioner is alleged to be the driver of the said car.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 22.09.2021, prosecution report has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Gaya in connection with Excise Case No. 261 of 2021.
