JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 03-07-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner seeks regular bail in connection with Mufassil P.S. Case No.196/16 registered for the alleged offences under Sections 30(a), 38 (i) and 41 (i) of the Bihar Prohibition and Excise Act and Section 120 B/34 of the Indian Penal Code. As per the prosecution case, several quantities of foreign liquor are said to have been recovered from the house of one Uday Singh. The petitioner is said to be the member of his gang indulged in the illegal inter-State trade of wine. It has been submitted by learned counsel for the petitioner that nothing incriminating article has been recovered from the conscious possession of the petitioner. He has no concern with illegal trade of wine. He has been falsely implicated

Patna High Court Cr.Misc. No.28914 of 2017 (02) dt.03-07-2017 2/2 in this case due to dirty village politics. He was not apprehended on the spot. He has no concern with the seized wine. He has been languishing in jail custody since 19.04.2017. In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistate, Nawada in connection with Mufassil P.S. Case No.196 of 2016.
