JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-06-2018 The petitioner seeks bail in anticipation of his arrest in connection with Kotwali P.S. Case No. 90 of 2017, dated 16.03.2017, instituted for the offences punishable under Sections 147, 148, 149, 151, 152, 153(a), 114, 115, 117, 341, 323, 342, 323, 332, 333, 352, 353, 337, 338, 307, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
Because of a dispute between two communities, an occurrence took place in which there was a blockade of the road and taking advantage of such disturbance, loot and
Patna High Court Cr.Misc. No.31467 of 2018 (3) dt.28-06-2018 2/2 arson was resorted to. Though the petitioner has been named along with forty five other accused persons, but it has been stated that his name has transpired on the statement of a local Chowkidar. Nothing specific has been alleged against the petitioner except for his having participated in the occurrence.
The petitioner is a student of graduation and is preparing for competitive examination.
Considering the aforesaid facts as also taking into account that the petitioner does not have any criminal antecedent, this Court is inclined to enlarge him on anticipatory bail.
Let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kotwali P.S.
