The petitioner apprehends his arrest in connection with Brahmpura P.S. Case No.42 of 2018 registered under Section 304 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Muzaffarpur.
The accusation is that Shyamali Devi, the maternal grandmother of the informant, was admitted in the Eye Hospital of Dr. Amrendra Jha, situated at Juranchapra, Muzaffarpur. Before her surgery, doctor asked her to take tablet. Thereafter, tablet and glass of water was handed over by the petitioner to her but after taking the same, she became restless. Later on, it was found that instead of water, acid was provided to the
Patna High Court Cr.Misc. No.29255 of 2018(2) dt.14-05-2018 2/2 maternal grandmother of the informant by the petitioner, who was compounder at the hospital.
Having considered the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
