2. The petitioner seeks bail in a case registered for offence under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 103(1) of the B.N.S., 2023.
3. As per F.I.R., on 18.03.2025 at about 11:30 AM, the son of informant was going to his sister's house and reached near Ramauli village, this petitioner and other co-accused persons named in the F.I.R. alongwith 8-10 unknown persons surrounded him and brutally assaulted believing him to be thief of buffalo, as a result of which, he died.
4. Learned counsel for the petitioner submits that informant is not eye-witness to the occurrence. Allegation of assault is general and omnibus. Similarly situated four co-
Patna High Court CR. MISC. No.53038 of 2025(3) dt.07-11-2025 2/2 accused have already been granted bail by a coordinate Bench of this Court, vide order dated 17.10.2025 passed in Cr.Misc. No. 56623 of 2025. Petitioner has got clean antecedent and is in custody since 24.03.2025. Chargesheet has been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Court No. 13, East Muzaffarpur / concerned Court in connection with Benibad P.S. Case No. 32 of 2025.
