The petitioner seeks bail in connection with Shakurabad P.S. Case No. 91 of 2015 registered for the offences punishable under Section 25(1-b)A and 26 of the Arms Act. Allegedly, three country made rifle, one country made single bore gun, one country made katta, 20 live cartridges 315 bore and 10 live cartridges of 12 bore were recovered from the house of the petitioner.
Submission is of false implication that the petitioner has been made victim of the circumstances, nothing has been recovered from his conscious possession and the police got his
Patna High Court Cr.Misc. No.3901 of 2016 (3) dt.17-03-2016 2/2 signature on the alleged seizure-list forcibly resulting he is suffering in custody since 05.08.2015, to which the learned APP opposes.
In the facts and circumstances stated above, considering the alleged recovery, at this stage, this Court is not inclined to enlarge the petitioner on bail and accordingly, his such prayer stands rejected in connection with Shakurabad P.S. Case No. 91 of 2015 pending in the court of learned Additional Chief Judicial Magistrate, Jehanabad.
However, considering the detention of the petitioner, let the trial be expedited.
