This application for anticipatory bail arises out of Gangabridge P.S. Case N0. 69 of 2019, disclosing offences under Sections 341,323,324,307,379,504,506/34 of the Indian Penal Code.

On perusal of the First Information Report, I find substance in the submission made on behalf of the petitioners that there is general and omnibus allegation of assault against the persons named in the First Information Report. There is allegation against co-accused Asmak Rai of having opened fire but evidently there is no fire arm injury, learned counsel for the petitioners contends. She has drawn my attention to an FIR registered

Patna High Court CR. MISC. No.50851 of 2019(2) dt.16-08-2019 2/2 prior to the present case as Gangabridge P.S. Case No. 67 of 2019 on the basis of written report of petitioner No.1. Considering the facts and circumstances, this application is allowed.

Let the petitioners above named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali in Gangabridge P.S. Case No. 69 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
