JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307/34 of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, this petitioner along with other accused persons fired on the chest of son of informant. It is further alleged that son of the informant had fled away with daughter of Aklu Ray for which Punaura PS case No. 101/2021 was registered in which after recording of statement of victim u/s 164 of the Cr. P. C. this petitioner and other accused persons used to threat the son of informant to kill him. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. There is no eye witness of the occurrence and only on

Patna High Court CR. MISC. No.65233 of 2021(3) dt.18-04-2022 2/2 suspicion petitioner has been made accused in this case. There is delay of two days in lodging the FIR. It is submitted that this case is counter blast of Punura PS case No. 101/2021. It is next submitted that though there is allegation of firing but the doctor found the injury to be simple in nature caused by hard and blunt object. Petitioner is in custody since 12.08.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Punaura PS case No.126/2021.
