The petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code.

Allegation is that on 25.03.2019 the informant had gone to the Civil Court, Nawada and he kept six mobiles and two headphones in the dicky of motorcycle at about 2.15 p.m. and when he came back at about 3.30 p.m. he found only one mobile in the dicky.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.06.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional

Patna High Court CR. MISC. No.51547 of 2019(2) dt.19-08-2019 2/2 statement of co-accused. The petitioner has not been put on T.I.P. There is no recovery of any incriminating article from the possession of the petitioner.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. case No.355 of 2019.
