The petitioner seeks bail in Ander P.S. Case No. 29 of 2019, registered for the offence punishable under Section 392 of the Indian Penal Code. Later on, sections 395, 412 of the IPC was added.
As per the prosecution case, while informant and his brother were returning home on motorcycle after closing their shop, on the way four miscreants riding on two motorcycles intercepted them and on the point of pistol looted cash, ATM card, mobile and other articles from their possession. Thereafter, all of them fled away.
It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has surfaced in this case on
Patna High Court CR. MISC. No.65461 of 2021(2) dt.24-02-2022 2/2 the basis of confessional statement of co-accused Babloo Kumar Yadav and Bajrangi Pandey and Babloo Kumar Yadav and coaccused Sonu Kumar Yadav have been granted bail by this Court. No looted article has been recovered from possession of this petitioner. Petitioner has not been put on test identification parade till date. Petitioner is in custody since 21.05.2021. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IX, Siwan in connection with Ander P.S. Case No. 29 of 2019.
