JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 17-05-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Makhdumpur (Tehta) P.S. Case No.29 of 2018 registered under Sections 341, 323, 379, 504 and 506 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that save and except Section 379 of the Indian Penal Code all other Sections of the Indian Penal Code are bailable in nature. So far as Section 379 of the Indian Penal Code is concerned, it has been submitted that the same has been added with a view to make the case severe and non-bailable.

Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioner.

No.29558 of 2018 (2) dt.17-05-2018 2/2 Having regard to the nature of offence, submissions made above and the statement made on oath that the petitioner has got no criminal antecedent, in the event of arrest or surrender in the court below within six weeks from today, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur (Tehta) P.S. Case No.29 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
