The petitioner apprehends her arrest in a case registered for the offence under Section 406/409 of the Indian Penal Code.
As per the prosecution case, all the F.I.R. named accused persons including this petitioner got certain amount for constructing a house under the Pradhan Mantri Awas Yojna (P.M.A.Y.), but they did not construct the house and defalcated government money.
It is submitted on behalf of petitioner that the house in question has already been constructed by the petitioner and in support of the same, she has annexed certificate of Mukhiya and Sarpanch alongwith a photo of the house (Annexure 2 series). Petitioner has got clean antecedent.
Patna High Court CR. MISC. No.55276 of 2022(2) dt.22-12-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Jhajha P.S. Case No. 272 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
