JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Kawakole P.S. Case No. 32 of 2015, registered under Sections 364, 120(B)/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that petitioners are not named in the F.I.R. as Kawakole P.S. Case No. 32 of 2015, under Sections 364, 120(B)/34 of the Indian Penal Code was instituted against Bihari Yadav and Subodh Yadav and in course of investigation, the Police apprehended the petitioner Gorelal Yadav @ Gora and got recorded his confessional statement showing his involvement and involvement of petitioner no.2 Rambilash Yadav, except that

Further submission is that while both the petitioners are accused in three other cases, as detailed in para 3 of the petition, but in all cases they are on bail. The petitioners are in custody since 23.11.2015 and 09.12.2015, respectively.

Having regard to the facts and the circumstances of the case, the petitioners, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M.IV, Nawada in connection with Kawakole P.S. Case No. 32 of 2015. Out of two sureties, one surety must be parents/close relative of the petitioners, who will file an affidavit showing their relation with the petitioners.
