JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but it would appear from perusal of the impugned order that petitioner was caught in Rosera P.S. Case No. 133 of 2015 in which he made his confessional statement disclosing his involvement in the present case also. Thereafter, the Officer in charge of Rosera Police Station called the informant, who went there and identified the petitioner. Moreover, it is alleged that ATM card of the informant was recovered from possession of the petitioner.
The contention on behalf of the petitioner is that
Patna High Court Cr.Misc. No.4060 of 2016 (2) dt.09-02-2016 2/2 nothing has been recovered from possession of the petitioner and moreover, petitioner has already been granted privilege of bail in Rosera P.S. Case No. 133 of 2015 whereas in the present case, he is languishing in jail custody since 20.08.2015. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Manjhaul, Begusarai in connection with CBR (Cheria Bariarpur) (Manjhoul) P.S. Case No. 50 of 2015.
