The petitioner seeks pre-arrest bail in connection with Bajpatti P.S.Case No. 334 of 2017 registered under Sections 147, 149, 188, 290 and 353 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that there was a peaceful jam for half an hour on the eve of bandh call given by a political party. It has further been submitted that from perusal of the FIR itself it would transpire that no obstruction was caused to any public servant in discharge of his official duty.

Considering the nature of allegation, in the event of arrest or surrender before the court below within four weeks from

No.29790 of 2018 (2) dt.17-05-2018 2/2 today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Pupri at Sitamarhi in connection with Bajpatti P.S.Case No. 334 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
