Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 366A/34 and other allied sections of the Indian Penal Code and section 8 of Protection of Children from Sexual Offences (POCSO) Act, 2012.

Patna High Court CR. MISC. No.54978 of 2022(2) dt.22-12-2022 2/2 Prosecution's case in short is that the petitioners and other accused persons took away the informant's minor daughter and on protest they assaulted the informant.

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. The victim in her statement recorded under section 164 Cr. P. C. has stated that she on her own free will left the house and came to the house of the petitioners and petitioners have not committed any wrong with her. Considering the aforesaid statement of the victim, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Exclusive Special Judge, POCSO Act cum Additional Sessions Judge VI, Munger in Kasim Bazar Police Station Case No. 143 of 2022, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
